Terms and Conditions
1. Scope of application
1.1. Diese Nutzungsbedingungen regeln die vertragliche Beziehung zwischen dem Verein Bewerbeagentur (bewerbeagentur) und den Nutzerinnen und Nutzern der Dienstleistungen der Bewerbeagentur, insbesondere der e-Learning-Programme und anderer Schulungs- oder Weiterbildungsangebote ("Training"), einschliesslich der in diesem Zusammenhang elektronisch oder anderweitig zur Verfügung gestellten Unterlagen ("Schulungsmaterial").
1.2. Mit der Anmeldung für ein Training der Bewerbeagentur über die Website der Bewerbeagentur unter www.bewerbeagentur.ch ("Website") akzeptiert der Nutzer diese Nutzungsbedingungen.
2. Services provided by bewerbeagentur
2.1. Bewerbeagentur provides its services to the participant in accordance with this user agreement, the training descriptions published on the website, and the terms and conditions specific to each training course.
2.2. The training courses are continuously developed and adapted by Bewerbeagentur. Bewerbeagentur reserves the right to modify the content and delivery of training courses in individual cases if this allows the respective training objective to be better achieved. In this case, the participant is not entitled to a refund of the participation fee paid.
2.3. Bewerbeagentur provides the participant with the training materials used in the training sessions. The provisions regarding the use of services according to section 3 and the provisions regarding intellectual property according to section 6 of these terms of use apply.
2.4. Bewerbeagentur may use or refer to third-party products or publications in its training sessions. Bewerbeagentur assumes no responsibility for these third-party products or publications.
3. Use of the service
3.1. The participant acknowledges that the trainings offered by bewerbeagentur and the training materials provided are intended exclusively for educational purposes.
3.2. The trainings offered by bewerbeagentur are intended exclusively for the personal and non-commercial use of the participant. In particular, the training materials provided may not be distributed, made publicly available, or used commercially.
3.3. bewerbeagentur delivers the trainings purely digitally as webinars and also provides the training materials online via the internet.
3.4. The participant undertakes to treat the access credentials provided by bewerbeagentur for the trainings and training materials as confidential and not to disclose them to third parties. Personal use only.
3.5. bewerbeagentur reserves the right, in case of violations of these terms regarding the use of bewerbeagentur services, to block the participant's access to trainings and training materials with immediate effect and to exclude the participant from ongoing trainings, without refund of training fees.
4. Postponement, cancellation, transfer
4.1. The following conditions apply to postponements and cancellations of a training by the participant (self-payer):
a. More than 21 days before the start of the training:
Postponement: free of charge
Cancellation: 20% of the costs
b. Between 21 and 7 days before the start of the training:
Postponement: 20% of the costs
Cancellation: 50% of the costs
c. Less than 7 days before the start of the training:
Postponement: 50% of the costs
Cancellation: 100% of the costs
4.2. Transfer of the registration to a third person is only possible with the prior consent of bewerbeagentur. As a rule, only the registered participant is entitled to take part personally.
5. Payment terms
5.1. The participation fee must generally be paid in advance upon registration, against a confirmation of participation and a receipt. bewerbeagentur uses a suitable electronic payment method for processing.
5.2. Payment by invoice is only possible in exceptional cases and only with the prior consent of bewerbeagentur. Unless otherwise stated on the invoice, a payment term of 20 days applies, after which the participant is in default.
5.3. Objections to an invoice must be submitted to bewerbeagentur in writing within 10 days of receipt at the latest, stating the reasons. Otherwise, the respective invoice is deemed to have been accepted.
5.4. If the participant has neither paid an invoice from bewerbeagentur within the deadline nor legitimately requested a postponement or cancellation, nor raised objections accepted by bewerbeagentur, bewerbeagentur is entitled to charge default interest and reminder fees and to initiate collection proceedings.
5.5. In the event of default, bewerbeagentur may charge the statutory default interest or exclude the participant from taking part in trainings or from receiving further services.
5.6. The participant bears all costs that may arise for bewerbeagentur as a result of the participant's default in payment, such as administration and collection costs (in particular reminder fees) and attorney's fees.
6. Intellectual Property
6.1. The copyrights and all other intellectual property rights to the training courses, the know-how imparted in the training courses and the training materials provided remain with the application agency.
6.2. Unless expressly provided for in these Terms of Use or a special agreement, the participant does not acquire any rights, titles or licenses to the trainings, the know-how imparted in the trainings or the training materials provided.
6.3. The participant is granted a non-exclusive and non-transferable right of use for personal purposes. The know-how imparted in the training courses and the training materials provided may not be sublicensed or sold, either in whole or in part. The distribution of the provided training materials is only permitted with the prior written consent of the recruitment agency.
6.4. The participant is not permitted to reproduce or publish the training materials provided, in whole or in part, even in edited form, without the prior written consent of the application agency.
6.5. Making image and/or sound recordings during a training session without the prior written consent of the recruitment agency or the respective training instructor is not permitted.
7. Liability and insurance
7.1. bewerbeagentur is liable only for intent and gross negligence. Liability is otherwise fully excluded.
7.2. bewerbeagentur cannot be held liable for damages that may arise from the participant's careless handling of the electronic access credentials.
7.3. If booked trainings cannot take place or are cancelled due to force majeure — for example, in the event of short-notice illness or accident of a trainer — no claims can be made against bewerbeagentur. bewerbeagentur will offer the participant an alternative date.
8. Data protection
8.1. The participant acknowledges and agrees that the recruitment agency collects, stores, and processes the participant's data as part of its business activities. The separate privacy policy on the website (www.bewerbeagentur.ch/datenschutz) applies.
9. Reservation of the right to amend
9.1. bewerbeagentur reserves the right to change these terms of use at any time with reasonable advance notice. The terms of use in force at the time of registration for the respective training apply.
9.2. Changes to these terms of use are communicated to the participant in an appropriate form and are deemed approved by the participant — absent objection — upon participation in the next training.
10. Final Provisions
10.1. Should individual provisions of these Terms of Use be invalid, ineffective or unenforceable, this shall not affect the validity of the remaining provisions and these Terms of Use.
10.2. The invalid, ineffective or unenforceable provisions shall be replaced by valid, effective and enforceable provisions which come as close as possible to the economic meaning of the invalid provisions.
11. Applicable Law, Jurisdiction
11.1. Diese Nutzungsbedingungen, die mit diesen Nutzungsbedingungen in Zusammenhang stehenden Leistungen der Bewerbeagentur unterstehen ausschliesslich Schweizer Recht.
11.2. Die Anwendung des Übereinkommens der Vereinten Nationen über Verträge über den internationalen Warenkauf vom 11. April 1980 („Wiener Kaufrecht“) ist ausdrücklich ausgeschlossen
11.3. Für die Beurteilung von Streitigkeiten aus oder um diese Nutzungsbedingungen oder den damit in Zusammenhang stehenden Leistungen der Bewerbeagentur sind die ordentlichen Gerichte am Sitz der Bewerbeagentur ausschliesslich zuständig. Die Bewerbeagentur kann Forderungen aber wahlweise auch vor den ordentlichen Gerichten am Wohnsitz des Teilnehmers geltend machen.

5.1. The user may at any time request that the recruitment agency provide them with a copy of their personal data or information about its use. Furthermore, the recruitment agency will correct or delete this data at the user's request, provided that this does not conflict with any legal obligations of the recruitment agency.

5.3. Your personal data will be deleted if there are no legal retention obligations to the contrary and if you have asserted a right to erasure, if the data is no longer required to fulfill the purpose for which it was stored, or if its storage is inadmissible for other legal reasons.
6. Duration of data storage
6.1. We only store personal data for as long as is necessary for the provision of our services and for the fulfillment of legal or contractual obligations.
Personal data relating to courses, coaching and services is generally stored for a maximum of two years after completion of the service and then deleted.
Any further storage or use will only take place if the data subject has given explicit consent, for example by means of a signed declaration of consent.
7. Updates to the privacy policy
7.1. The recruitment agency reserves the right to amend this privacy policy at any time within the framework of legal requirements.
